3                    subject matter of dispute

3.1               DRS dispute Networks Rail’s confirmed engineering access plan to deliver:

·         Grangemouth Jn S&C renewal / remodelling and other disruptive work to be delivered concurrently between Stirling and Hilton Jn.

·         Montrose S&C renewal / resignalling and other disruptive works to be delivered concurrently between Dundee and Aberdeen

·         Stirling – Alloa – Kincardine Enhancement Project and other disruptive works to be delivered concurrently between Larbert and Hilton Jns

3.2               This dispute arises over the interpretation of condition D2.1.4 Network Rails Rules of the Route/Plan Decision and the application of D6 the Decision Criteria.

4                    summary of dispute

4.1               DRS are concerned about the disruptive affect of possessions required to undertake the S&C renewal at Grangemouth Jn and the cancellation of their Anglo-Scottish services between West Midlands and Scotland and internal services between Grangemouth and Aberdeen (Issue in Dispute 5.1.1).

4.2               DRS have objected to the volume of disruptive possessions planned between Grangemouth and Aberdeen and the number occasions this prevents their 7 day a week WH Malcolm/ASDA services from operating (Issue in Dispute 5.1.2).


 

5                    explanation of each issue in dispute with response

5.1.1    Since its first intermodal service in 2001, DRS has brought a range of completely new customers to rail including premium brand organisations such as ASDA, IKEA, Diagio and Tesco.  All these volumes have been new to rail and have been won from road on the basis of a safe secure and reliable service delivered at a cost effective price.  These customers now rely on rail for a more attractive distribution service direct to the stores and have reduced their own in house road capability on the basis of the rail service performance.  These premium FMCG services are both high profile and vital to the ongoing growth of rail freight in the UK.  The domestic intermodal market sector is highly competitive with customers having the ability to switch from rail back to road if they see any significant deterioration in performance.  The proposals by Network Rail for 2007 for what in effect will amount to more than 50 cancellations in individual services over a 5 month period will put service performance levels at a totally unacceptable level and will result in the loss of this business back to road.  In the past Network Rail have worked successfully in partnership with DRS to convince customers that they are fully supportive of their move to rail and together we have minimised disruption to deliver the performance that the customer has demanded.  This proposal completely undermines this process and will serve to reinforce the traditional view that the railway is inflexible and unreliable.  We urge Network Rail to reconsider its proposals and work with DRS to continue to deliver the required performance.

5.1.2           The requirement to undertake the renewal of the S&C at Grangemouth Jn is based upon the age and condition of the infrastructure. Deferral of work from 2007, already re-dated from 2006, would introduce performance risks, including the possible imposition of TSR’s. Network Rail has made use of the renewals opportunity to improve the layout of Grangemouth Jn and reduce the disruptive access required to undertake the work.

Grangemouth Junction renewal/remodelling - Network Change applies

Re-modelled option with elimination of switch diamonds identified as optimum solution to reduce potential performance risks.  Single lead junction proposed to provide turnback facility from both Up & Down Branch.  Signal positions to cater for longer length freight trains.  Line speed improvements on main line (from 30mph to 50mph) and branch (from 15mph to 25mph).

Failure to undertake the renewal works planned at Grangemouth Jn will result in Network Rail having difficulties in maintaining infrastructure performance and availability between Grangemouth and Aberdeen.  Deferral of these works in to 2008 will increase the pressure for the disruptive access between Grangemouth and Aberdeen in a year that existing planned work volumes are envisaged to be greater than the work volumes planned for 2007.

On all of these occasions DRS are prevented from accessing their Grangemouth Terminal.  These works were first presented to DRS in informal discussions back in February 2005 by Network Rail’s Territory Delivery Planning Unit (Scotland).  These works continued to be developed within Network Rail’s engineering access plan with all affected operators via the Evolution and ROTR planning processes. 

During the 2007 RotR consultation process Network Rail and DRS met to review the 2007 RotR proposals on the 13th April and 8th August 2006. As a result Network Rail evaluated a number of diversionary options for DRS traffic when routes carrying their traffic were disrupted – unfortunately these proved to be of limited benefit, mainly due to restrictions on the Forth and Tay Bridges. During the second meeting Network Rail offered to meet with DRS/WH Malcolm to discuss their concerns and to explain the need for the disruption to their services as currently proposed – but this offer has not as yet been taken up by DRS.

                Network Rail has secured the support of GNER and First ScotRail for this possession strategy.  Network Rail’s original proposals have been changed to resolve Operators objections for Weeks 46 to 48 to Week 47, 51 & 52, but these changes have not changed the number of instances where DRS services would be affected. 

5.2.1     Following the success of the Anglo-Scottish flow between Daventry and Grangemouth in April 2004 DRS launched a new to rail service from Grangemouth to Aberdeen as an extension of its existing service.  At the request of customers WH Malcolm and ASDA, the service runs 7 days per week.  As with all DRS intermodal services, these trains convey often perishable supermarket goods, and are required daily at the Aberdeen terminal for onward road haulage to eight supermarkets.

The success of these services is due to DRS building the customer’s confidence in rail freight, an ongoing process which has built up over a five year relationship.  The net effect of Network Rail’s proposals is to undermine this hard work, making a return to road haulage likely if rail is unable to provide a reliable alternative.

5.2.2           The 2007 RotR access proposals being disputed by DRS are part of the overall programme of disruptive works planned for Scotland. These have been structured to address a range of considerations including, Anglo-Scottish route availability for long distance freight and passenger traffic, deadlines imposed for completion of Scottish Executive funded schemes, Operators preferences for when and how key works should best be undertaken, the practicalities of delivering the work while minimising overall disruption to customers, and TSR effects.

Failure to undertake the works proposed will result in difficulties in maintaining infrastructure performance and availability between Grangemouth and Aberdeen, major issues for all Operators with the re-dating of deferrals into 2008 and subsequent years, and will delay Government funded Enhancement schemes - this would be undesirable for the Rail Industry as a whole.

The S&C and Plain Line worksites programmed in Scotland for 2007 are all in locations where the age and condition of the infrastructure necessitates renewal rather than ongoing maintenance. Deferral of any of the 2007 work will introduce performance risks, including the possible imposition of TSR’s, and increase disruptive access required on these routes in future years.

When Network Rail informally tabled at discussions with the DRS the initial 2007 possession plan the volume of work proposed totalled 15 occasions when DRS services were affected between Grangemouth and Aberdeen, Network Rail has been able to optimise the work plans and reduce the number of disruptive occasions to only 10. The 2006 disruptive engineering access plan between Grangemouth and Aberdeen affected DRS services on 15 occasions, Network Rail has made all efforts to ensure that the 2007 access plans causes the minimum disruption to DRS services.

On average, more than 3 days of core renewals / Enhancements work are packaged to be undertaken each day that disruptive access is proposed on routes between Grangemouth and Aberdeen, thus reducing the number of days DRS traffic is disrupted. The S&C works cannot be undertaken in fewer days as signalling resources are already fully utilised, while increasing the number of routes affected on each occasion would result in excessive bussing operations for Passenger Operators.

The Schemes for delivery within the disruptive engineering access planned between Grangemouth and Aberdeen and the benefits to DRS are summarised below:

Montrose S&C renewal/remodelling/resignalling – Network Change applies

Re-modelled layout with rationalisation of signalling control areas agreed (Usan and Montrose South boxes to close) – this enables freight and passenger services to loop at Montrose without Montrose North signal box having to be opened specifically for that purpose - as is the case currently.

Down Through Siding to be recovered with alternative freight looping facility to be provided on Down Line by re-instatement of north end trailing crossover.

Mossend-Elgin freight re-gauging (Scottish Executive funded scheme)

This is a £20m scheme to increase the clearance for freight trains over the routes between Mossend-Larbert-Stirling-Perth-Aberdeen-Elgin from W7 to W8+ gauge (9’6’ high, 8’2.5’’ wide boxes on 700mm low bed FLA wagons).

Stirling-Alloa-Kincardine re-opening (Scottish Executive funded scheme)

This is a £35m scheme whose primary freight objective is the re-routing of Hunterston-Longannet coal traffic off the Forth Bridge. It also enables a switch from HAA to HTA coal wagons, thus increasing the tonnage of coal transported by rail, reducing infrastructure degradation and risk of delays to other traffic. The Scheme should free up paths for additional passenger services between Fife and Edinburgh, and passenger services between Stirling and Alloa will resume.

Larbert Jn to Stirling re-signalling :-

The renewal of the Larbert-Stirling semaphore-type signalling equipment (40 years old) will increase route capacity such that additional passenger and freight services may be able to run via the route. This provides 3-aspect signalling between Greenhill Lower Jn – Grangemouth Jn – Stirling and aligns with DRS’s aspirations to run more services out to Scottish destinations using Grangemouth as a hub.

As a result Network Rail evaluated a number of diversionary options for DRS traffic when routes carrying their traffic were disrupted – unfortunately these proved to be of limited benefit, mainly due to restrictions on the Forth and Tay Bridges as container sizes would be required to reduce to 8ft 5”. DRS investigations have concluded that no such small containers are in existence.  During the second meeting Network Rail offered to meet with DRS/WH Malcolm to discuss their concerns and to explain the need for the disruption to their services as currently proposed

(b)                 Network Rail is seeking the Committee to request Direct Rail Services to accept the 2007 V2 ROTR disruptive engineering access plan detailed affecting the services described between Grangemouth and Aberdeen, and between Grangemouth and Daventry.
